Terms of Sale

1. Booking and Payment

All sessions must be booked in advance. A booking request can be made by email, WhatsApp or via the website. The booking becomes effective once a confirmation has been sent by email to the customer.

1.1 Two payment methods are available:

Bank transfer

- Payment can be made by bank transfer in advance of the session.

- Bookings will be confirmed by e-mail once payment has been received.

Cash payment (euro €)

- Cash payment on the day of the session may be accepted, subject to prior agreement.

- If you pay in cash, we will contact you by email or WhatsApp 48 hours before the session to confirm your attendance.

- If we don't get any reply 24 hours before the session, the booking will be automatically cancelled and the session will not take place.

2. Cancellation

- Bookings are non-refundable but can be rebooked for another date, subject to availability.

- No refunds will be given for late arrivals or withdrawals during the session.

- In the event of bad weather and if the activity can be carried out safely, payment for the service is due.

- The instructor cannot be held responsible in the event of cancellation or modification of the activity due to an external event (closure of ski lifts, extreme weather, strikes, pandemics, natural disasters, etc...). If conditions allow, a new programme will be put in place to run the session. If conditions do not allow a session to be held safely, it may be postponed (subject to availability) or cancelled.

- If the cancellation comes from us, a pro rata refund of the services not provided will be made, without any additional compensation.

3. Safety and responsibility

- Wearing a helmet is obligatory during the activity.

- Wearing suitable protection (glasses, knee pads, elbow pads, back protectors, etc.) is strongly recommended.

- Each participant attests:

> Have no medical condition that would prevent participation in mountain biking or sporting activity in the mountains.

> Be covered by civil liability, accident and assistance insurance.

> For unaccompanied minors, a medical certificate and a copy of the insurance contract must be provided.

The instructor reserves the right to:

>Exclude at any time a person whose behaviour is likely to disrupt the progress and safety of the session. In this case, the customer will not be able to claim any reimbursement.

>Modify or cancel an activity in the event of dangerous conditions or unforeseen circumstances, in the interest of the group.

- In accordance with the law, all participants are advised to take out additional insurance covering the activities concerned (mountain biking, enduro mountain biking, downhill mountain biking).

4. Participant responsibility

- Behaviour and safety: Each participant undertakes to respect the safety instructions given by the instructor and to adopt respectful behaviour towards other participants, equipment and nature.

- State of health: The participant declares to be in good physical condition to participate in the activity, and assumes responsibility for any health problems during or after the activity.

- Equipment: If the participant uses his own equipment, he ensures that it is in good working order. The instructor may refuse to have a participant participate if the material appears dangerous.

5. Instructor's responsibility

Mountain biking sessions take place in a potentially dangerous and sometimes unpredictable environment. Participants must therefore take personal responsibility for their own safety and that of others. The instructor’s liability is limited to a duty of best efforts. It is the participant's responsibility to follow the instructor's instructions. The participants are solely responsible for their own equipment. The instructors cannot be held responsible for any damage caused by this equipment or in the event of theft or damage.

6. Prices

The prices shown include the services of an instructor and exclude all other services (insurance, ski lifts, equipment, transport, accommodation, etc...), except in special cases. Consequently, prior to the lesson time, the participant must bring the necessary equipment, the compulsory gear, if necessary a lift pass for access to the lifts and, if he/she so chooses, insurance to cover him/her against the risks inherent in mountain sports (civil liability, rescue, etc...).

7. Right of withdrawal not applicable, regardless of the method of booking

The right of withdrawal within a period of 14 days provided for in article L221-18 of the French Consumer Code does not apply to services offered for sale in application of 12° of article L.221-28, in the case of leisure activities that must be provided on a specific date.

8. Privacy and personal data

Personal information collected during booking is used only for the management of sessions and will not be transmitted to third parties without prior consent. The customer can, at any time, request to consult, modify or delete their personal data by sending a request from the site.

9. Changes and updates to the Terms of Sale

Terms of Sale may be modified or updated at any time. The new conditions will apply to all bookings made after their publication.

10. Disputes, mediation and jurisdiction

These terms and conditions are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before considering legal proceedings. In the event of a dispute which has not been resolved by an amicable solution and which has been the subject of a written complaint sent by the consumer customer to the company, the customer may submit the dispute to the consumer mediator whose contact details are as follows: Société de Médiation Professionnelle Alteritae, 5, rue Salvaing, 12000 Rodez. Finally, the competent court will be that of the instructor's domicile.
